PAYMENTS

All payments to PrizmaPhoto are final and non refundable. In the event of a cancellation a credit will be issued equal to the paid amount to use towards any future similar service offered by PrizmaPhoto. (Excludes printed products). 

The Client must inform PrizmaPhoto of any cancellation at least 24 hours before the scheduled session or event. Failure to inform PrizmaPhoto of a cancellation or no shows will not receive a credit. 

PrizmaPhoto credits never expired. They are non transferable and the Client understand that PrizmaPhoto will work in good faith to grant the usage of any issued credit.

MODEL RELEASE

The CLIENT/PARENT OR GUARDIAN hereby grants to PRIZMA PHOTO and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the minor or in which the minor may be included, for editorial, trade, advertising, social media and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT/PARENT OR GUARDIAN hereby releases PRIZMA PHOTO and its legal representatives and assigns from all claims and liability relating to said photographs. Client herby give the PHOTOGRAPHER/PRIZMA PHOTO and Assigns my permission to license the Content and to use the Content in any media for any purpose. (except pornographic and defamatory) which may include, among others, advertising, promotion, marketing and packaging for any products or service. Client agrees that the Content may be combined with other images, text, graphics, film, audio, audio-visual works; and may be cropped, altered or modified. Client acknowledges and agrees that Client has consented to publication of Client/Child ethnicity (ies) and gender as indicated. But understand that other ethnicities or gender may be associated with the (CLIENT/PARENT OR GUARDIAN and Child) by the photographer and/or Assigns for descriptive purposes. Client agrees that he/she has no rights to the Content, and all rights to the content belong to the PHOTOGRAPHER/PRIZMA PHOTO and Assigns. Client acknowledges and agrees that he/she has no further right to additional consideration or accounting, and that Client will make no further claim for any reason to Photographer/Prizma Photo and/or Assigns. Client acknowledges that this release is biding upon his/her heirs and assigns. Client agrees that this release is irrevocable, worldwide and perpetual, and will be governed by the laws (excluding the law of conflict) of the country/state from the following list that is nearest to the address of the CLIENT/PARENT OR GUARDIAN given opposite: New York, Alberta, England, Australia and New Zealand. Client agrees that his/her personal information and the child will not be made publicly available but may only be used directly in relation to the licensing of the Content where necessary (e.g. to defend claims, protect rights or notify trade unions) and may be retired as long as necessary to fulfill this purpose, including by being shared with sub-licensees/assignees of the Photographer/Prizma Photo and transferred to countries with different data protection and privacy laws where it may be stored, accessed and used. Client represents that he/she is at least 18 years old of age and have the full legals capacity to execute this release.

IMAGE DELIVERY AND STORAGE

PrizmaPhoto does not keep local copies of any photos or digital files after any event. All images and digital files will be available to the client to order and download in an online gallery. There is a 90 days complimentary online gallery hosting service included with PrizmaPhoto services. After this period and once the gallery has expired is the sole responsibility of the Client to pay for any fees associated with the recovery or retrieval of any images.
